Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of: being stuck-by equipment. The employer fails to protect the employees from potential caught between and struck by hazards associated with operating a Bobcat skid steer loader Model #236 with a person in the bucket. On or about December 29, 2010, a person riding in the bucket fell out and was injured when the vehicle ran him over. Among others, feasible and acceptable means of abatement include, not allowing employees to enter, ride and work from the buckets of front end loaders or similar equipment as described in the manufacturer's warnings, and the Equipment Manufacturing Institute Safety Manual.
