Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of heat stress:
For employees exposed to tasks such as but not limited to mechanic,
construction, and material
handling work in hot environments located in the truck yard, mechanic
shop, and field. The
employer did not ensure that employees were protected from heat related
illnesses through a
comprehensive heat stress management program. The employer's program had a
number of
deficiencies that could lead to serious harm or death to employees.
Means of feasible abatement to correct the hazard(s) include, but not be
limited to:
1. Establish provisions for a work/rest regimen so that employee exposure
to high temperatures
is decreased by decreasing the work rate and increasing the rest periods
in length and frequency.
This may be accomplished by doing the heavier metabolic load work such
loading and unloading
trailers and heavy equipment in the early morning.
2. Medical managment of heat related illnesses in the early stages that
are reported or observed
by employees so that prompt medical treatment can be provided.
Predisposing factors of
employees such as age, weight, and cardiovascular system should be
accounted for not only in
the early hiring and orientation stages but continuously during the hot
months and conditions.
3. A heat acclimatization program to increase heat tolerance to new
employees and employees
returning from periods of absence of 3 or more days.
4. The use of heat stress instruments to monitor the work environments and
the National
Weather Services Heat Advisory days so the work/rest regimens discussed
above may be
adjusted appropriately to prevent heat exhaustion/strokes.
5. A continuing effective heat stress training program on the hazards of
heat-related illness, the
signs and symptoms of a heat-related illness, and the importance of
immediate reporting to onsite
management of any of the signs/ symptoms or any observation of any
employee with the
signs/symptoms of a heat related illness.
