Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling from elevation: a) On or about March 3, 2011, at the jobsite, employee(s) were exposed to a fall of approximately 12 feet to the concrete ground level below in that an operator was not present to operate the controls and/or the platform of Skylark RSC 6036 all terrain forklift while lifting employee(s). One feasible and acceptable abatement method, among others, would be to comply with the ASME B56.6-2002 para. 5.15.1(s) Safety Standards for Rough Terrain Forklift Trucks, which requires a trained operator be in position to control the rough terrain fork truck.
