General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fall, struck-by and crushed-by: a) On or about 03/16/11, and times prior thereto, an employee was operating a Toyota forklift, model# 42-6fgcu25, s/n: 70938, to load and unload semi- trailers. The employer did not ensure that employees operating powered industrial trucks use seatbelts, exposing employees to the hazard of falling out of and being struck by the powered industrial truck. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to require the use of the seat belt in accordance with the Consensus Standard ANSI/ITSDF Safety Standard for Low and High Lift Trucks B56.1-2000, Section 5.3.19 which states: "An active operator protection device or system, when provided, shall be used."
