Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of being struck- by a motor vehicle.
For sales and delivery operations in Taylor, TX: On or about May 05, 2011,
employees exiting
the vehicle were exposed to hazards from the movement of a delivery truck
while performing
house calls in a residential neighborhood.
Feasible means of abatement for this hazard, among others, includes the
following measures:
1. Establish and communicate standard procedures to ensure nearby
personnel are visually
located outside of an established danger zone before moving vehicles or
equipment.
2. Maintain visual contact between the driver and worker(s) on foot.
3. Operators must posses a valid driver license.
4. Train employees in the safe operations of the vehicle utilizing the
owner operator manual.
5. Establish and maintain a safety and health program for the employee(s)
to follow.
Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date
of this citation, the
employer must submit documentation showing that it is in compliance with
the standard,
including describing the steps that it is taking to ensure that employee
are not exposed to hazards
of moving trucks.
