Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by the front end loader: a) Containment Building Unit, 115 Jacobus Avenue, Kearny, NJ The employer did not ensure that employees were not in the path of the Volvo Front End Loader and that a safe clearance distance was maintained, on or about 4/23/10. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the Volvo Loader Operator's Manual, as outlined on page 74, and take steps to prevent employees from entering or remaining in the danger area, a distance of 23 feet in all directions from the maximum reach of the loader.
