Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a fall hazard of 7 feet 4 inches when performing installation of ceiling
lighting from a Skyjack
scissors lift without the midrail chain in place:   Among other methods,
one feasible and
acceptable means of abatement would be for the employer to ensure the
employees using this
Skyjack scissors lift follow the American National Standard for
Self-Propelled Elevating Work
Platforms (ANSI A92.6-1999) that requires in Chapter 7.10 (4) that the
operator use the
guardrail system installed and positioned per the manufacturer's
instruction.  The Skyjack
manufacturer instructions state "Do not use without railings, lock pins
and entry gate/chain/bar
in place."
