Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which was free from recognized hazards that are causing or likely to cause death or serious physical harm to his employees in that employees were exposed to crushing hazards. (a) On or about December 1, 2010 and at times prior thereto, employees were exposed to a struck by and crushing hazard while operating an 843 Bobcat skid steer without functioning interlocks on the seat bar. (b) On or about December 1, 2010 and at times prior thereto, employees exposed to a crushing hazard while operating an 843 Bobcat skid steer that was not equipped with a working audible back up alarm. Abatement Note: Among other methods, one feasible and acceptable method to correct the hazard is to follow the manufactures safety requirements located in the operations manual, which are also addressed in NIOSH alert 98-117 Preventing Injuries and Death from Skid Steer Loaders. Abatement Note: Abatement certification and documentation is required for this item.
