Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which are free from
recognized hazards that are causing or likely to cause death  or serious
physical harm to his
employees in that employees were exposed to struck by hazards.
(a) On or about January 04, 2011 and at times prior thereto, employees
were exposed to
struck by hazards while elevating vehicles using a hydraulic single post
lift with non-
functioning locks on the front and rear cross arms to do fork lift repairs
and maintenance.
(b) On or about January 04, 2011 and at times prior thereto, employees
were exposed to
struck by hazards while elevating vehicles using a hydraulic single post
lift
without having a
rated load capacity posted.
(c) On or about January 04, 2011 and at times prior thereto, employees
were exposed to
struck by hazards while elevating vehicles using a hydraulic single post
lift with the lack of
documented annual inspections performed by a certified lift inspector.
Among other methods, one feasible and acceptable method to correct the
hazards noted is to
follow the requirements in ANSI/ALI ALOIM 2008 which include, among other
requirements, the following:
1.    Institute a preventive maintenance program according to the
manufacturer's
specifications.
2.    Provide training to employees on proper use and care of the lifts.
3.    Schedule and complete all periodic and annual inspections.
4.    Post and maintain load rate chart with the load limit designated by
the owners manual.
Abatement Note:  Abatement certification is not required for this item.
