Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck by hazards. (a) On or about March 01, 2011 and at times prior thereto, employees were exposed to being struck by vehicles while elevating vehicles using a single post air over hydraulic lift with non-functioning locks on the telescoping swing arm stops. (b) On or about March 01, 2011 and at times prior thereto, employees were exposed to being struck by vehicles while elevating vehicles using a single post air over hydraulic lift without having a rated load capacity posted. (c) On or about March 01, 2011 and at times prior thereto, employees were exposed to being struck by vehicles while elevating vehicles using a single post air over hydraulic lift due to lack of effective employee training in that employees were lifting vehicles without daily checks and reporting of deficiencies. (d) On or about March 01, 2011 and at times prior thereto, employees were exposed to being struck by vehicles while elevating vehicles using a single post air over hydraulic lift with the lack of planned lift maintenance. Among other methods, one feasible and acceptable method to correct the hazards noted is to follow the requirements in ANSI/ALI ALOIM 2008 which include, among other requirements, the following: 1. Institute a preventive maintenance program according to the manufacturer's specifications. 2. Provide training to employees on proper use and care of the lifts. 3. Post and maintain load rate chart with the load limit designated by the owners manual. Abatement Note: Abatement certification and documentation is required for this item.
