Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck by hazards. (a) On or about March, 01, 2011 and at times prior thereto, employees were exposed to a struck by hazard while elevating vehicles using lifts without having a rated load capacity posted. (b) On or about March, 01, 2011 and at times prior thereto, employees were exposed to a struck by hazard while elevating vehicles using lifts with the lack of documented annual inspections performed by a certified lift inspector. (c) On or about March, 01, 2011 and at times prior thereto, employees were exposed to a struck by hazard while elevating vehicles using lifts due to lack of effective employee training in that employees were lifting vehicles without daily checks and reporting of deficiencies. (d) On or about March, 01, 2011 and at times prior thereto, employees were exposed to a struck by hazard while elevating vehicles using lifts that had hydraulic leaks and exposed electrical wiring connections. Among other methods, one feasible and acceptable method to correct the hazards noted is to follow the requirements in ANSI/ALI ALOIM 2008 which include, among other requirements, the following: 1. Institute a preventive maintenance program according to the manufacturer's specifications. 2. Provide training to employees on proper use and care of the lifts. 3. Schedule and complete all periodic and annual inspections. 4. Post and maintain load rate chart with the load limit designated by the owners manual. Abatement Note: Abatement certification and documentation is required for this item.
