OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish
employment and a place
of employment which were free from recognized hazards that were causing or
likely to cause
death or serious physical harm to employees in that employees were exposed
to struck by
hazards.
On or about March 26, 2011 and at times prior to this date, employees were
exposed to
struck-by hazards from logs rolling off logging trucks.  Employees were
not prohibited from
entering the hazard area alongside and underneath logging trucks without
first determining if
it is safe to enter the area and that the logs are saddled within the
stakes or secured by the
log loader.
Abatement Note: Among other methods, one feasible and acceptable method to
correct the
hazards noted is to follow the requirements in "Rules Relating to Logging
and Logging
Operations in Montana", published by The Montana Department of Labor and
Industry
and
the Montana Logging Association which includes, among other requirements,
the following:
Section 5. A. 6. No person shall enter the hazardous area alongside or
underneath a log truck
being loaded without establishing communication with the loading machine
operator and
determining that it is safe to enter the area and that the logs are
saddled within the stakes or
secured by the log loader.
Abatement Note:  Abatement certification is required for this item.
