Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: a)Spohns Disposal Service Inc., on or about 08/03/10: Employees operated a Bobcat 863 skid loader when the audible backup alarm was not working. Among other methods, some feasible and acceptable methods to correct this hazard is to: (1) Ensure that the skid loader is in good operating condition and that all its safety equipment is correctly installed and utilized, (2) Ensure that the operator's manual is maintained in the operator's cab, (3) Ensure that every operator is familiar with the safety equipment to include its function and purpose, (4) Instruct operators to report malfunctions or unsafe conditions prior to operation. Abatement certification must be submitted for this item.
