Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to THE HAZARD OF BEING STRUCK-BY A LOAD:
a)Service Department, on or about 11/3/10:  The following Challenger
vehicle
lifts used were not maintained in safe operating condition:
2)Challenger, Model 24012AR, Serial No. 030300000003076, had the
rear front safety rod bent and warning labels were missing.
Among other methods, one feasible and acceptable abatement method to
correct these hazards is to conduct inspections of the lifts as recommended
by the manufacturer to ensure safe operation and to remove damaged lifts
from service until rendered safe for use.  Also, follow the requirements of
ANSI/ALI ALOIM-1994, Safety Requirements for Operation, Inspection and
Maintenance, Section 5, Periodic Qualified Inspection and Section 6,
Maintenance.
b)Service Department, on or about 11/04/10:  Jacks used to support
vehicles for
servicing purposes were not marked with load capacity ratings and had never
been inspected.
Among other methods, one feasible and acceptable abatement method to
correct these hazards is to determine the load rating of each jack and mark
them accordingly.  Also, follow the inspection requirements of ANSI B30.1-
1975 Jacks, Chapter 1-2 Inspection, Testing and Maintenance.
Abatement certification must be submitted for this item.
