North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)jobsite, employee(s) were exposed to a fall of 15' 8" when climbing from the guardrail of a fixed industrial stairway to the top of a metal roof awning in order to access the fixed ladder to the roof. Among other methods, one feasible and acceptable method to abate this hazard is to provide direct fixed ladder access to the roof.
