North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) within the facility, the employer did not ensure that the AFM Fabteck press brake was operating properly to prevent employee exposure to caught in-between hazards. Reference: ANSI B11.3 - 2002 (R2007), American National Standard for Machine Tools - Safety Requirements for Power Press Brakes. Among other methods, one feasible and acceptable method to abate this hazard is to ensure press brakes are operating properly through regular inspections and maintenance.
