Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire and explosion because air material seperators were located inside the building and were not designed to minimize damage that would occur in the event of a dust explosion: a)dye mixing area, a Sly dust collector was installed inside the room and were not vented to the outside, did not contain an explosion suppression system, and was not designed to minimize damage. b)dye mixing area, the Sly dust collector contained metal ductwork that was not grounded to prevent static spark explosions. c)dye mixing area, for piping and ductwork that was connected to the Sly dust collector that was not protected by deflagration isolation systems. NOTE: Among other methods, some feasible and acceptable methods to abate these hazard are: 1)Comply with National Fire Protection Association (NFPA) 69, "Standard on Explosion Prevention Systems" (2008). 2)Comply with NFPA 654 (2006), Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids. NOTE: This includes provisions for grounding of the entire system including duct work and deflagration isolation systems including, but not limited to, flame arresters, spark detection, and spark extinguishing systems.shing
