North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushed by object hazard. a)Tire Center - employer did not establish or maintain a periodic inspection procedure in accordance with the recommendations of the lift manufacturer on two Rotary automotive lifts (Model# SPOA10N700, Capacity 10,000 pounds). Reference:ANSI/ALI 2000 (American National Standards Institute /Automotive Lift Institute) Standard for Automotive Lifts - SAFETY REQUIREMENTS FOR OPERATION, INSPECTION, AND MAINTENANCE. ANSI/ALI-2000 (Section 5.1, page 6): Qualified Inspection Procedure. The owner or employer shall establish a periodic inspection procedure in accordance with the recommendations of the lift manufacturer in order to ensure reliability and allow the safe operation of the lift. Please be reminded that certain sections of U.S. Code of Federal Regulations , Title29, Section 1910 and applicable subparts - Occupational Safety and Health Administration, General Industry Standards may pertain to the procedures anticipated by this section. Compliance with applicable regulations is left to the person(s) involved. One feasible and acceptable method of abatement is for the employer to establish a periodic inspection procedure for the automotive lifts in the Tire Center and follow the preventative maintenance inspections as recommended by the manufacturer.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushed by object hazard. a)Tire Center - a record of each periodic inspection performed by a designated and qualified inspector was not maintained and could not be verified. Reference:ANSI/ALI-2000 (American National Standards Institute/Automotive Lift Institute) Standard for Automotive Lifts - SAFETY REQUIREMENTS FOR OPERATION, INSPECTION, AND MAINTENANCE. ANSI/ALI-2000 (Section 5.4, page 7): Qualified Inspection Documentation. A record of each periodic inspection shall be prepared and maintained noting the observations and findings of all points of inspection recommended by the manufacturer as well as subsequent repairs or replacements accomplished. One feasible and acceptable method of abatement is for the employer to record and retain periodic inspections conducted by a qualified inspector for the automotive lifts in the Tire Center and follow the preventative maintenance inspections as recommenced by the manufacturer.
