North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to being caught between a tractor and the earth hazards. a)Maintenance yard - The John Deere compact utility tractor model #750 with the roll over protection system had a dry rotted seat belt that was not affixed to its anchor point. Abatement note: One means of abatement would be to purchase and mount a fresh seat belt equipment on all equipment with roll over protection devices according to the manufacturer's requirements.
