North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Crushed by collapsing lifts. a)facility, tire installation area - where three Joyce-style single mast pneumatically controlled hydraulic lifts were not being used in the fully extended height such that the safety latches did not deploy. Abatement note: One means of abatement would be to only use the three Joyce-style single mast pneumatically controlled hydraulic lifts in their fully extended position and use more appropriate equipment for operations at a lower height. Reference: ANSI/ALI ALOIM-2000. 4.4.2 The operator shall use all applicable safety features provided on the automotive lift.
