North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to cave ins and engulfments while working in an excavation, IAW the provisions of para 2.2 ANSI A10.12-1998: a)site-the contractor did not prepare an excavation safety and health plan as required by the referenced standard. One feasible means of abatement is prior to excavation activities, prepare an excavation safety and health plan as required by the ANSI. standard.
