North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing injury. a)facility, production floor segment A - employee was operating a Chicago Dreis & Krump mechanical press brake #331 that was not being inspected on a periodic basis to ensure that safe guards were in safe operating condition and adjustment. This condition resulted in an accident, that occurred on 6/14/2010, where the ram drifted down causing a compound fracture in two places, to the employees right ring finger. b)facility, production floor segment A - an emergency stop button was not provided for one employee operating the Chicago Dreis & Krump Mechanical Power Press #331. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct the hazard is to develop a program of periodic and regular inspections in accordance with the Operator's Instruction Manual NO. ADI-9006 which includes ANSI B11.3-1982, section 5.1.4. 2)Among other methods, one feasible and acceptable abatement method to correct this hazard is to install an emergency stop button in accordance with the Operator's Instruction Manual NO.
