North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from elevation: a)"Tunnel" blood loading area - when the assigned driver was unable to perform loading operations, facility employees were tasked to stand on top of the trailer 10 feet above the floor without the benefit of fall protection while transferring turkey blood from a holding tank. Abatement note: One means of abatement would be to purchase or fabricate a trailer access platform with a guardrail system.
