Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Foot controls and/or foot pedals used to engage/activate the hand-fed bag printing presses were not guarded to prevent unintended actuation. Equipment includes but is not limited to the following: a) Schmutz: (3) Color Printing press; Model no.: HA 1950, Serial no.: 2250 b) Schmutz: (2) Color Printing press; Model no.: LH 1949, Serial no.: 2072 c) WooShine:(2) Color Printing press NOTE: A feasible and acceptable means of abatement includes but is not limited to the following: Compliance with the American National Standard Institute (ANSI) B11.3 2002,[Section 6.11.3.1] which states that, "when provided foot controls and/or foot pedals of the types that serves as an operator control shall be equipped with a means to prevent unintended machine actuation".
