Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to a caught between hazard: On or about May 6, 2010, and at other times prior thereto, at this job site, employees driving the International truck tractors and pulling CPS belly dump trailers were exposed to a caught-between hazard while entering through the air- operated belly dump doors. Among other methods, one feasible and acceptable means of abatement involves lock out of the doors in accordance with the manufacturer's instructions as posted on the vehicle, as well as adhering to the ANSI/ASSE Z244.1, "Safety Requirements for the Lockout/Tagout of Energy Services."
