Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to impalment hazards: a) South Entrance: Employees were doing roofing work and were walking and working at, near, and over unguarded 1/2 inch diameter lightning rods that extended approximately 15 inches from the roof deck. Among other methods, one feasible and acceptable abatement method to correct this hazard is to cover the protruding ends of the rods with protective caps: 383 Middle Street Project: Employees were exposed to impalement hazards while working at, over, and near unguarded lightning rods.ning
