Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to fall hazards: Worksite: An employee was on a mobile scaffold that was being elevated by a Toyota forktruck. The scaffold platform was elevated about 8 feet above the forks and 16 feet above the ground. The fork lift was also moving while the employee was elevated. Among other methods, on feasible and acceptable abatement method to correct this hazard is to design and use a work platform in accordance with generally recognized consensus such as American National Standards Institute (ANCI) B56.1 Safety Standard for Low Lift and High Lift Trucks.
