Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:08/25/10 Location:Inside Building, Second Floor. Condition:Employees used the top step of a 12-foot Werner brand fiberglass stepladder that did not extend 3 feet above the opening to access the roof, which was located approximately 13 feet above the concrete floor. Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with 1910.25(d)(2)(xii) and 1910.25(d)(2)(xv), Standards for the Use of Portable Wood Ladders. The proposed penalty for this item has been reduced by 50for effective and efficient abatement during the inspection.
