Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: : (a)Date of Violation:06/03/10 Location:Eastbound U.S. Route 50 Near Bay Dale Drive Condition:An employee monitoring/checking traffic data collection equipment installed across three lanes of traffic was not protected from being struck by motor vehicles by the use of a spotter to monitor traffic as the employee worked in the roadway. Among other methods, one feasible and acceptable method to abate this condition, is to provide a traffic spotter for employees working in the roadway at all times. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
