Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by vehicular traffic:
a) for employees working as cashiers and order-takers in the drive-thru
lane of the
McDonalds restaurant located at 28215 South Tamiami Trail in Bonita
Springs (FL),
as observed on or about 3/30/10.  Employees were placed in these positions
during
rush-hour lunch to expedite the flow of business traffic.  Employees were
not
protected from being struck by vehicles moving through the drive-thru
lane.
Although the order-takers could stand on a curb, the curb would not
protect them
from being struck by an errant vehicle.  Also, although there was a
concrete bollard
to protect the corner of the building as patrons would pull round the
building
after
ordering, there was no barrier to protect the employee(s) who deliver the
food or
collect the money.
Abatement Note(s):  One feasible and acceptable abatement method includes,
but
may not be limited to: removing employees from the drive-thru lane.
