Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Cornstarch dust found on the floors, machinery, and electrical installations in Athens and Apollo fillo dough processing areas, was a Class II explosive dust. The following conditions found at the facility increase the potential for an explosion and/or severity of an explosion: a.Areas were considered to be Class II, Group G, Division 1 locations and the exterior walls were constructed of concrete block. b.There was no explosion relief venting distributed over the roof and walls. c.Methods were not used to prevent the escape of dust from process equipment into the surrounding environment.
