North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/caught-in hazards: a)jobsite, on March 9, 2010, an employee was observed riding as a passenger on a Kotmasu WA320 loader that was being driven up an earthen ramp. One feasible method of abatement is to follow the manufacturers guidelines and not allow anyone apart from the operator ride on the machine.
