North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)jobsite, an employee was operating the #3 Stihl Model MS 460 without a chain catch. Reference:American National Standard for Arboricultural Operations Safety Requirements, ANSI Z133.1-2006, Section 6.3.2. "Chain Saws shall not be operated unless the manufacturers safety devices are in proper working order". Among other methods, one feasible and acceptable method is to maintain all safety devices required by the manufacturer.
