employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to hazardous chemical vapors from Freon R-22,
chemically referred
as chlorodifluoromethane.
a)In and around the compressor/refrigeration machinery room:  On June 20,
2010 and at times prior to, employees were exposed to the hazards of Freon
R-22 chemically referred to as chlorodifluoromethane during emergency
situations and leaks associated with the mechanical refrigeration system
for the
Ice Palace.
b)  In and around the compressor/refrigeration machinery room:  On June 20,
2010 and at times prior to, employees were exposed to the hazards of Freon
R-22 chemically referred to as chlorodifluoromethane during emergency
situations by the employer not having installed a Freon R-22 monitoring
system interlocked with a ventilation system that was adequate enough to
exhaust air from the room in the event of a leak or rupture in such a
manner
as not to cause a nuisance or danger to employees.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to provide an adequate functional detection system that would
actuate an
alarm and mechanical ventilation at an exhaust rate sufficient to remove
vapors out of
the Mechanical Refrigeration Room in accordance with the American Society
of
Heating Refrigeration and Air-Conditioning Engineers (ASHRAE) "Safety Code
for
Mechanical Refrigeration" standard #15.
