North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a)on the construction site, an employee was exposed to a 13'6" fall hazard while riding/working from the forks of the GEHL RS5-34 Telescopic Handler. REFERENCE: GEHL RS5-34 Telescopic Handler Operator's Manual, which states "the machine must not be used to lift or carry personnel". NOTE: Among other methods, a feasible and acceptable method to abate this hazard is not to allow employees to ride/work from the forks of the handler.
