North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to struck by hazards:
a) at the worksite, the employer did not provide eye, face and head or leg
protection
for an employee who was using a chain saw to cut down a dead tree.

Among other methods, one feasible and acceptable method to abate this
hazard
is to ensure employees are provided with personal protective equipment for
their
heads, face and eyes and legs.
