Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicular traffic: a) in that employees performing landscape work were observed without high visibility safety apparel while exposed to vehicular traffic, as observed on or about 03/19/2010. Among other methods of abatement, feasible and acceptable methods to correct this hazard include: 1. Implementing a policy which prohibits working in close proximity to vehicular work. 2. Requiring employees wear high-visibility clothing which meets the State of Florida DoT requirements.
