Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of struck-by or crushing by a powered industrial truck: a) Location - Establishment: On or about April 23, 2010, employees operating the powered industrial truck outside the building in areas of slope and potholes while carrying slabs of stone were not wearing the manufacturer supplied seat belt. Among other methods, one feasible and acceptable abatement to correct this hazard is to enforce the wearing of seat belts when operating powered industrial trucks.ial
