Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or physical harm to employees
in that employees
were exposed to: Cuts

proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a: Cortaduras
On December 10, 2010 inside the construction Project Margaritasville
located on Luis
Munoz Marin Airport, Edificarte Inc failed to ensure that all employees
remained outside of
an identified danger zone to avoid repeat an incident.  On or about 10:00
am during a wall
demolition operation, cinder blocks fell from second floor to the first
floor
where two
American Airlines' employees were working. The concrete pieces fell off
from the roof (12
feet height) through an air conditioning duct.  It was documented that the
employer stopped
operations but their employees remained in the Project (second floor).  On
or about 1:15pm,
another episode of falling pieces were reported due to an employee
continue cleaning and
removing concrete pieces on the affected area.  After the second incident
the employer
decide to closed the project doors and maintain employees outside to
correct the problem
before continuing operations.
Among other methods a feasible and acceptable method to correct this
hazard is:
Stop operations inmediatelly, remove employees and only authorized
personell continue
evaluation and remedation
El 10 de diciembre de 2010, dentro del proyecto de construccion
Margaritasville localizado
en el Aeropuerto Luis Munoz Marin, Edificarte Inc fallo al no asegurar que
todos sus
empleados se mantuvieran fuera de una zona identificada como peligrosa
para evitar repetir
un incidente.  A las 10:00am durante la operacion de demolicion de una
pared, bloques de
concreto cayeron del segundo al primer piso donde empleados de American
Airlines estaban
trabajando. Los pedazos de concreto cayeron del techo (12 pies de alto)
atravez de un ducto
de aire acondicionado.  Se documento que el patrono detuvo operaciones
pero los empleados
permanecieron en el proyecto (segundo piso).  A la 1:15 pm otro episodio
de pedazos de
concreto que cayeron fue reportado debido a que un empleado continuo
limpiando y
removiendo bloques de concreto en el area afectada.  Luego del segundo
incidente, el
patrono decidio cerrar las puertas del proyecto y mantener los empleados
fuera para corregir
el problema antes de continuar operaciones.
Entre otros metodos, un metodo factible y aceptable para corregir este
riesgo es:
Detener inmediatamente operaciones, remover empleados y solo personal
autorizado
continuar con la evaluacion y remediacionn.
