Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an ejection hazard in the event that the unrated wire hook ratchet straps failed while using the aerial lift as a crane. Among other methods, one feasible and acceptable abatement method to correct this hazard is to have lifting devices properly marked with the rated load per manufacture instruction in accordance with Paragraph 21-3.1.1 of the American Society of Mechanical Engineers (ASME) B30.21-2005, Manually Lever Operated Hoists - Safety Standard for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall/struck-by hazards in the event that the aerial lift tipped, when working from the aerial lift, while being used as a crane. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow manufacturer instruction in accordance with Paragraph 8.10.12 of the American National Standards Institute (ANSI) - Scaffold Industry Association (SIA) A92.5-1992, American National Standard for Boom-Supported Elevating Work Platforms.
