Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)Ground floor: An employee was exposed to falling approximately 20 feet due to tipping of a Genie model AWP 30-S aerial work platform unit that was moved with an employee on the raised platform. On or about 5/20/10. Abatement Note Among others, a feasible method to eliminate or to materially reduce this hazard would be to not move the platform unit with the platform raised as detailed in the Genie Operators Manual (Part No. 82910). NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
