North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) at the facility, Room 366, an employee stood on top of a 6 ft A-frame ladder to access an HVAC valve in the ceiling. Reference: ANSI A14.5-2007, American National Standard for Ladders - Portable Reinforced Plastic - Safety Requirements. Among other methods, one feasible and acceptable method to abate this hazard is to ensure employees are adequately trained on ladder safety which will enable them to choose the appropriate equipment to assist them in reaching components needing repair or adjustment.
