Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or crushed-by hazards: (a)On or about July 28, 2010 at the SW corner of S 4th and Broad Streets, Gadsden, AL - One employee was operating a powered industrial truck without using the seat belt. Among other methods, one feasible and acceptable method to correct this hazard is to ensure that all powered industrial truck operators utilize the restraint devices provided on the truck as stated in ASME B-56.1-1993 - Safety Standard for Low Lift and High Lift Trucks, Section 7.39, Operator Restraint Systems.
