Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to hazardous chemical vapor from Freon R-22: a.On or about August 3, 2010 - Employees working at Costco Store #356 were exposed to the unexpected release of Freon-22, chemically referred to as chlorodifluoromethane, as a result of leaks associated with the mechanical refrigeration system. A Freon R-22 leak detection system was not installed at the compressor/refrigeration machinery room. Among other methods, one feasible and acceptable method to correct this hazard is to provide a detection system that would actuate an alarm and mechanical ventilation at an exhaust rate sufficient to remove vapors in accordance with the American Society of Heating Refrigeration and Air-Conditioning Engineers (ASHRAE), "Safety Code for Mechanical Refrigeration", Standard #15-2007.
