Section 5(a)(1) of the Occupational safety and Health Act of 1970 - The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to struck-by hazards: (a)
Civil Construction
LLC at 2614 Schuster Drive, Cheverly, MD: On or about June 24, 2010, the
employer did
not ensure that one employee who was bundling railing, adjacent to the
Komatsu excavator
serial number 40997, model # PC 228 USLC-3EO, remained out of the swing
radius of the
excavator bucket, thus exposing the employee to serious injury or death by
being
struck by
the excavator bucket. The hazard posed by swinging buckets is plainly
obvious; is described
in industry safety literature. Among other means to correct this hazard
one feasible and
acceptable abatement method can be found in the Society of Auto Engineers
(SAE) J153,
Surface Vehicle Recommended Practices.
(a) Worksite - A laborer was struck by the Komatsu Model PC 228 USLC-380
excavator bucket within 4ft of where he was bundling rails, on or about
6/24/10.
