Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a. At the site - the Caterpiller 936F Wheel Loader was used to transport and lift an employee to obtain the trench box chains from the anchor points on the top of the 10 ft high trench box. The employee was exposed to a potential crush and/or fall hazard. Violation observed on or about 05/19/10. Feasible and acceptable methods of abatement include, but are not limited to the following: 1. Follow the operator's manual safety precautions and warnings 2. Prohibit the use of the front end loader to lift and transport personnel
