Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer does not
furnish employment and a place of employment which is free from recognized
hazards that are
causing, or likely to cause, serious physical harm to employees in that
employees are exposed
to engulfment hazards:
At this location, employees are not provided procedures identifying means
for
safely entering standing water. This violation occurred on 07/14/2010
where an
employee walked into standing water without having been provided a safe
procedure for guarding against potential dangers from engulfment in a
washout.
An acceptable means of abatement would be to develop and implement safe
practices and methods for entering standing water and to provide a device
to
detect submerged washouts, such as a probe.
Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date
of this
citation, the employer must submit documentation showing it is in
compliance
with the standard, including describing the steps it is taking to ensure
safe work
policy and procedures are developed, implemented and communicated to
employees engaged in pipeline repair where entry into water is required.
