Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) On or about June 2, 2010 workers rode in the bucket of a 345
Caterpillar excavator to egress
a single story roof section. Riding in the bucket exposed the workers to a
potential crushing
hazard in the excavator's articulating arm and a potential fall hazard in
excess of 6 feet to the
debris pile below.
Among other methods one feasible and acceptable method to correct this
hazard would be to
place a ladder the foot of the wall structure for access and egress to
roof edge as well as follow
the Association of Equipment Manufacturers safety manual for compact
excavators which
states,"Never use an attachment for a work platform or personnel carrier."
