Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.In the yard, the Caterpillar 330 D scrap handlers were used when the rear view mirrors, on both sides of the handlers, were missing, thus exposing employees to a struck-by hazard. Among other methods, feasible abatement methods to correct this hazard include, but are not limited : (1) assure that handlers with missing or non-operational safety features are taken out of service and repaired before use (2) assure that operators are trained on and complete daily equipment inspections and follow-up on any deficiencies, (3) Comply with ASME 25-3.3.2 and 25-3.1.2.
