Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an impalement hazard from unprotected rebar: a.At the rear of the grain facility where employees work on top of the bulk corn storage to pull tarps over the bulk corn, the employer failed to install protection over the reinforced steel rebar thereby exposing employees to an impalement hazard. 1.Among other methods, one feasible and acceptable means of abatement would be to install rebar impalement protection caps over the tops of the rebar to protect employees from impalement hazards. 2.Another feasible means of abatement to correct the hazard would be to install guard rails around the perimeter of the corn ring where employees walk to stretch the tarp and around the ladder access.
